Guest Booking & Stay Policies 

Terms, Conditions, and Legal Disclosures for Mt Burgess Guesthouse

Please read these Terms, Policies & Conditions carefully before confirming your reservation. By completing your booking, you acknowledge and agree to the terms outlined below, which apply both before and during your stay at Mt. Burgess Guest House.

 

These booking terms form a legal agreement between you (or your legal entity) and Mt Burgess Guesthouse (MBG) for the provision of vacation rental accommodation services. MBG offers short-term accommodation at the property located at 314 Kicking Horse Avenue, Field, BC V0A 1G0. These terms apply to all bookings made for this accommodation and are governed by the laws of British Columbia, Canada. By confirming a reservation, you acknowledge that you are at least 19 years of age, legally able to enter into a binding contract, and agree to comply with these terms.​​​​​

Definitions

These definitions apply to all sections of our Booking Terms & Policies:

Business Days: Refers to Monday through Friday, excluding public holidays in British Columbia. All communication, processing, and scheduling are based on business days.

No-Show: A guest who does not arrive for their reserved stay and does not provide prior notice of cancellation or delay.

Late Arrival: Arriving more than 10 minutes past the scheduled time may result in a shortened session or cancellation, depending on availability.

Force Majeure: Events beyond our control — such as natural disasters, extreme weather, or government restrictions — that may impact service delivery. In such cases, cancellation fees may be waived.

Non-Refundable Payments or deposits labeled as non-refundable will not be returned under any circumstances, unless otherwise stated.

Refundable Payments eligible for return, provided cancellation or rescheduling occurs within the defined notice period.

Rescheduling Clients may reschedule appointments with at least 24 hours’ notice. Requests made after this window may be subject to cancellation fees.

Deposit A partial payment required to secure a booking. Deposits may be non-refundable or transferable depending on the service and notice period.

Client Responsibility Clients are expected to arrive on time, follow pre-appointment instructions, and disclose any relevant health conditions or concerns.

Service Guarantee

While we strive for excellence, individual results may vary. Satisfaction is important to us, and concerns should be raised within 48 hours of service.

Age Requirements Clients must be at least 18 years old to book services. Minors may be accommodated with written parental or guardian consent.

  • “Guest House,” “our,” “we,” or “us” refers to Mt. Burgess Guest House, located at 314 Kicking Horse Avenue, Field, British Columbia — the premises for which your booking is made.

  • “Lead Guest,” “Registered Guest,” or “you” means the person or company booking the stay and providing credit or debit card details to secure the reservation.

  • “Booking,” “Reservation,” or “Stay” refers to the booking for accommodation and any other services or items made with us.

  • “Group Booking” means a booking for more than one suite.

  • “Website” refers to mtburgessguesthouse.com  or mtburgessguesthouse.ca..

  • “Terms,” “Conditions,” or “Policies” means these Terms, Conditions, and Policies.

  • “Agreement” means this document, including all terms, conditions, and policies contained herein, as amended from time to time.

  • “Calendar Day” means the period from one midnight to the following midnight, including Saturdays, Sundays, and holidays.

Reservation Confirmation

A booking is considered confirmed once MBG has accepted your reservation and received one of the following:

  • Full payment of the total booking amount,

  • A deposit as specified in your Booking Confirmation, or

  • A valid payment card successfully pre-authorized for at least the value of any applicable cancellation fee.

Once confirmed, you will receive a Booking Summary with a reservation number. Please note that, except as outlined in our cancellation policy, you do not have a statutory right to withdraw from this agreement.

If your initial payment is less than the full amount, the remaining balance will be collected according to the schedule in your Booking Summary, or upon arrival, unless otherwise agreed in writing.​

Rates & Taxes​

The rates listed in your Booking Summary or on our website should be accurate at the time of booking. If you notice any discrepancies, please contact us right away so we can resolve them promptly.

Rates are specific to the number of guests, dates, duration, and apartment(s) shown in your Booking Summary. 

  • All prices are quoted in Canadian Dollars (CAD)

  • Rates are based on double occupancy (1–2 guests)

  • A surcharge of $30 per night applies for each additional guest

  • Applicable taxes include:

    • GST (5% federal sales tax)

    • PST (8% provincial sales tax)

  • A 2.9% Convenience Fee applies to debit/credit card payments (excluding reservation deposits).

  • A 4.2% Convenience Fee applies to payments made via American Express.

 

Rates may vary during holiday periods or peak seasons, and are subject to change without notice. However, once your booking is confirmed, your rate is locked in—even if tax regulations change after your reservation.

 

Please note: The total price shown in your confirmation does not include additional goods, services, or taxes incurred during your stay unless explicitly stated. If you’ve selected any booking extras, their cost and applicable taxes will be added to your reservation total.

Extraordinary Costs

Guests are responsible for covering any extraordinary costs incurred during their stay. These may include, but are not limited to:

  • Excess Cleaning

Charged when cleaning requires significantly more time or effort than usual to restore the suite and its contents to their original condition. This may include removal of excessive dirt, grease, mess, or stains on carpets, upholstery, linens, and towels.

  • If an item cannot be restored, we reserve the right to charge for its replacement.

  • A collection of retired towels is provided for guests to use for any messy tasks.

  • Room Recovery Fees

Up to $500 may be charged for violations of our No Smoking, Scent-Free, or No Pets policies.

  • Excess Cleaning Fee

Up to $500, depending on the extent of the cleaning required.

  • Lost Key Fee

$100 per key.

 

All fees related to Room Recovery, Excess Cleaning, Loss or Damage to Property, and Lost Keys will be charged to the Lead Guest’s credit or debit card within seven days of check-out.

Pricing Errors

In the rare event that a pricing error prevents us from fulfilling your confirmed reservation, we will notify you as soon as possible and issue a full refund of any amount paid. Please note that we are not liable for any indirect costs, losses, or damages resulting from such errors or omissions.

Unavailability of Accommodation

In the rare event that we are unable to provide the accommodation you booked due to circumstances within our control, we will:

  • Refund your deposit in full

  • Assist in identifying alternative accommodations, including placing a temporary hold if needed. Final booking and payment will be made directly by you with the alternative provider.

We do not assume responsibility for third-party bookings or associated costs, but we will do our best to support you in finding a suitable replacement.

Check-in and Check-out

Check-in and check-out times are specified in your booking summary. If you expect to arrive later than the stated check-in time, please notify the guest house in advance. Failure to arrive before the latest check-in time without prior notice may result in the cancellation of your booking. In such cases, any applicable fees or retained amounts will be handled in accordance with our Cancellation Policy.

Cancellation and Amendments​

Please note that your invoice total may change if you modify the number of guests or nights, adjust your reservation dates, or switch the apartment(s) you’ve booked.

Our cancellation policies are outlined on our website — specifically on the FAQ and Policies page, and via the Booking Terms link in the footer. When booking direct — whether through our website, by phone, email, or in person — you must confirm that you’ve read and accepted our Property Policies, which include the booking and cancellation terms. These terms are also included in your booking summary.

 

​To cancel or amend your booking, please contact us directly via email, phone, or text.

Cancellation Fees

  • 15 days or more before arrival: Full refund of payments made, minus a CAD 75 cancellation fee per apartment booked.

  • 8 to 14 days before arrival: CAD 75 cancellation fee(s) apply. Your booking deposit may not be refundable, as outlined in your Booking Confirmation. MBG is under no obligation to hold the accommodation.

  • Within 7 days of arrival or on the arrival date: We may charge the full outstanding balance of your original reservation to your credit card.

  • No-show or failure to contact us by arrival date: Your booking may be considered cancelled in full. MBG is under no obligation to hold the accommodation for any of the dates booked.

If you request changes we are unable to accommodate, your booking may be cancelled and a refund issued according to the terms above.

 

Please note: If you booked through a third-party platform (e.g., Airbnb, Booking.com), their cancellation policies may apply instead. We recommend reviewing their terms directly.

Payments​

To confirm your reservation, you must provide a valid payment card or another accepted payment method during the booking process. The total amount payable will be quoted in your Booking Summary and charged at the time of booking. If your card is declined, your booking may be automatically cancelled.

At the end of your stay, you are responsible for settling any remaining balance, including charges for additional goods or services purchased during your stay, as well as any extraordinary costs incurred. If you depart without paying any outstanding amount, we reserve the right to charge the payment card provided at the time of booking.

We may use your payment card details to guarantee your reservation in accordance with PCI-DSS security standards, or to collect any deposit due at the time of booking. We may also pre-authorize or charge your card for cancellation fees or additional deposits, as outlined in your Booking Summary.

If your card was charged prior to arrival, any amount paid will be deducted from your final balance.​​

If your card was pre-authorized prior to arrival, we will either charge the pre-authorized amount or cancel the pre-authorization and apply a new charge. Please note: a pre-authorization is not a charge, and no funds are withdrawn from your account. However, your bank may temporarily reduce your available credit by the pre-authorized amount. When settling your bill, we will ensure any outstanding pre-authorization is either charged or cancelled and replaced with a final payment.

Liability​

We strive to present our accommodations online as accurately as possible. However, we cannot guarantee that they will meet your individual expectations. If you have any concerns or questions, please contact us before booking. We’ll do our best to provide the information you need and ensure you feel confident about your stay.

Please note that our liability is limited to the total cost of your booking, except in cases of death or personal injury resulting from our negligence. We are not responsible for any indirect, consequential, or special damages. We will not be liable where we have exercised reasonable care and skill in providing our accommodations, nor for any failure to perform due to circumstances beyond our control. For this reason, we strongly recommend purchasing appropriate travel insurance.

You are responsible for any damage or loss caused by your actions during your stay, including damage to our property. You agree to indemnify us for any necessary repairs or replacements. We reserve the right to terminate your booking without refund or compensation if your behaviour is deemed unacceptable or disruptive to staff or other guests.

Data Protection

We take your privacy seriously. Your personal information may be used to fulfil our obligations under this Agreement and may be processed by trusted third-party providers who support our website, reservation system, payment processing, or booking channels. This data transfer is essential to complete your booking.

We may also be required to share certain information with financial, judicial, administrative, law enforcement, or legal authorities if requested or required under applicable laws and regulations.

While we have received assurances that these third parties comply with global data protection standards, we cannot be held responsible for their use of your data. If you have concerns, we encourage you to contact them directly.

 

By completing a booking, you consent to the processing and transfer of your information as described above. After your stay, you may request that we delete or return your data in a reasonably accessible format, unless retention is required by law.

Note: We do not collect or store your credit card or payment details. All payment information is handled securely by Freetobook’s PCI Level 1 compliant gateway.

  • Improve our services (e.g., via optional feedback)

We retain your data only as long as necessary for legal, administrative, or customer service purposes.

Data Security

We follow strict security protocols aligned with the General Data Protection Regulation (GDPR) to prevent unauthorized access or misuse. Access to your data is limited to authorized personnel only.
